BY CLICKING "I ACCEPT," OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS, INCLUDING LU'S PRIVACY POLICY (TOGETHER, THESE "TERMS").
ARBITRATION NOTICE. Except for certain kinds of disputes described in Section 17, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND LU ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
1. LU Service Overview.
LU provides movement, meditation, and breathwork classes digitally.
2. Disclaimer.
YOU SHOULD BE AWARE THAT THERE ARE INHERENT HEALTH RISKS TO EXERCISE, INCLUDING RISK OF INJURY. BY ACCESSING THE SERVICE, YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOUR PERFORMANCE OF ANY AND ALL EXERCISES OR ACTIVITIES RECOMMENDED BY THE SERVICE IS WHOLLY AT YOUR OWN RISK.
WE HIGHLY RECOMMEND YOU SEEK GUIDANCE FROM A MEDICAL DOCTOR OR OTHER QUALIFIED HEALTH CARE PRACTITIONER IF YOU ARE PREGNANT, HAVE ASTHMA, OR HAVE ANY PREEXISTING INJURIES OR CONDITIONS.
YOU MUST DISCONTINUE EXERCISE IN CASES WHERE IT CAUSES PAIN OR SEVERE DISCOMFORT.
3. Eligibility.
You must be at least 18 years old to use the Service.
4. Accounts and Registration.
To access most features of the Service, you must register for an account. You are solely responsible for maintaining the confidentiality of your account and password. If you believe that your account is no longer secure, then you must immediately notify us at support@lu-app.com.
5. Invite a Friend.
LU may offer you the ability to send your friends an email requesting they join the Service.
6. General Payment Terms.
Certain features of the Service may require you to pay fees. All fees are in U.S. Dollars and are non-refundable, except as described in our Refund Policy available in our FAQ.
6.1 Price. LU reserves the right to determine pricing for the Service.
6.2 Authorization. You authorize LU to charge all sums for the orders that you make and any level of Service you select.
6.3 Subscription Service. The Service may include automatically recurring payments for periodic charges. You must cancel your subscription before it renews.
6.5 Delinquent Accounts. LU may suspend or terminate access to the Service for any account for which any amount is due but unpaid.
7. Licenses.
7.1 Limited License. LU grants you, solely for your personal, non-commercial use, a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service.
7.2 License Restrictions. You may not (a) reproduce, distribute, publicly display the Service; (b) make modifications; or (c) interfere with or circumvent any feature of the Service.
8. Ownership; Proprietary Rights.
The Service is owned and operated by LU. All Materials included in the Service are the property of LU or its third-party licensors.
9. Third Party Terms.
9.1 Linked Websites. The Service may contain links to third party websites. LU is not responsible for their content.
10. User Content.
10.1 Certain features of the Service may permit users to upload content. You retain any copyright and other proprietary rights you may hold in the User Content.
10.2 By providing User Content, you grant LU a worldwide, non-exclusive, royalty-free, fully paid right and license to host, store, transfer, display, perform, reproduce, and distribute your User Content.
11. Communications.
11.1 Text Messaging. LU may send you SMS messages. You may opt out by sending an email to support@lu-app.com.
11.2 Push Notifications. You can turn off notifications in your device's settings.
11.3 Email. You may opt out of promotional emails by following the unsubscribe instructions.
12. Prohibited Conduct. BY USING THE SERVICE, YOU AGREE NOT TO:
12.1 use the Service for any illegal purpose;
12.2 harass, threaten, demean, embarrass, or otherwise harm any other user;
12.3 violate any right of a third party;
12.4 interfere with security-related features;
12.5 interfere with the operation of the Service, including by uploading viruses or malware;
12.6 perform any fraudulent activity;
12.7 sell or transfer the access granted under these Terms;
12.9 self-promote or advertise personal services.
13. Modification of these Terms.
We reserve the right to change these Terms upon 7 days' notice.
14. Term, Termination and Modification of the Service.
14.1 These Terms are effective when you first use the Service.
14.2 Termination. LU may terminate these Terms or your account at any time. You may terminate by contacting support@lu-app.com.
14.3 Effect of Termination. Your license rights will terminate; you must cease all use of the Service.
14.4 LU reserves the right to modify or discontinue the Service at any time, temporarily or permanently, without notice.
15. Indemnity.
You will defend and indemnify LU from claims brought by a third party arising out of your use of the Service.
16. Disclaimers; No Warranties.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." LU DISCLAIMS ALL WARRANTIES.
17. Limitation of Liability.
LU IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID IN THE 12 MONTHS PRIOR; OR (B) $100.
18. Dispute Resolution and Arbitration.
18.1 Disputes will be resolved by binding arbitration. YOU AND LU ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
18.2 Exceptions: small claims court; injunctive relief; intellectual property infringement claims.
19. Miscellaneous.
19.1 These Terms, with the Privacy Policy, are the entire agreement.

20. Notice Regarding Apple.
This Section applies only to iOS devices. These Terms are between you and LU only, not Apple Inc. Apple is not responsible for the Service.
Public Offer (Russian jurisdiction)
The public offer (oferta) is a legal document governed by the laws of the Russian Federation and is provided in Russian for users purchasing the Service from Russia. The full text of the public offer is available at /terms/?lang=ru#oferta.
If you are purchasing the Service from outside Russia, your contractual relationship with LU is governed by the Terms of Use (see the first tab) and the Privacy Policy (see the third tab).
